EFEKTIVITAS PENERAPAN E-COURT PERKARA CERAI GUGAT DI PENGADILAN AGAMA BALIKPAPAN KELAS 1A

Abstract

Advances in information technology have prompted the Supreme Court of the Republic of Indonesia to transform its judicial system through the implementation of e-Court. This system is regulated by Supreme Court Regulation (PERMA) Number 7 of 2022 and aims to increase efficiency, transparency, and ease of access to electronic judicial services. The Balikpapan Religious Court is one of the institutions that has implemented this system, particularly in divorce cases, which have seen a steady increase in cases year after year. This situation raises questions about the effectiveness of the e-Court system in accelerating and simplifying the legal process for justice seekers. This study aims to describe the implementation of e-Court in handling divorce cases at the Balikpapan Religious Court and to assess its effectiveness in supporting the principles of fast, simple, and low-cost justice. The study employed a qualitative approach and utilized field research methods. Data collection techniques included interviews with relevant parties such as judges and court clerks, collection of case documents, and a literature review. Based on research results, the implementation of e-Court at the Balikpapan Religious Court is considered quite effective because it can accelerate administrative processes and reduce the cost burden on litigants. Furthermore, this system also increases transparency and public access to judicial services. However, its effectiveness still faces several obstacles such as unstable internet network quality, low public understanding of digital technology, and technical errors in the document upload process that cause delays. Therefore, steps are needed, such as increased socialization, training on system usage, and strengthening the technological infrastructure to support the optimization of e-Court implementation going forward.
