PENERAPAN KAIDAH USHUL FIQH DALAM REKOMENDASI DISPENSASI KAWIN : TELAAH PERTIMBANGAN KEMASLAHATAN DI PENGADILAN AGAMA MOJOKERTO

Abstract


The importance of considering the merits in the marriage dispensation decision by the judge of the Religious Court. The marriage dispensation given to minors is not only related to legal-formal aspects, but must also pay attention to the principles of sharia maqashid, which emphasize the protection of soul, intellect, descent, and honor. The large number of dispensation requests based on social pressure or out-of-wedlock pregnancy has the potential to have a greater impact if it is not accompanied by the psychological, emotional, and economic readiness of the bride-to-be. Therefore, judges need to consider the benefits so that the decisions taken really provide benefits and prevent social damage. Thus, the role of judges is not only as a law enforcer, but also as a guardians of sharia and humanitarian values.
