ANALISIS PUTUSAN PN SURABAYA NO. 916/Pdt.P/2022/PN/Sby TENTANG PERNIKAHAN BEDA AGAMA PERSPEKTIF HUKUM KELUARGA ISLAM DI INDONESIA

Abstract


This research aims to understand how Islamic family law in Indonesia evaluates the Surabaya District Court decision Number 916/Pdt.P/2022/PN/Sby, which has become controversial in society due to conflicts between marriage law and administrative law, resulting in the marriage being approved and legalized by the Surabaya District Court. This qualitative research uses a library research approach with a comparative descriptive model, which includes analysis of previous court decisions relevant to this topic. The methods used in this research are document study and literature study. The results of the research indicate that first, the basis for the judge's consideration in the Surabaya District Court decision Number 916/Pdt.P/2022/PN/Sby regarding the application for registration of interfaith marriage includes several legal considerations, namely jurisprudence from the Supreme Court decision Number 1400/K/Pdt/1986 dated January 20, 1989, Article 35 letter a of Law Number 23 of 2006 concerning Population Administration, Article 6 paragraph (1) and Article 7 of Law Number 1 of 1974 concerning Marriage, Article 8 letter f of the Marriage Law, and human rights by the provisions of Article 28 B paragraph (1) and Article 29 of the 1945 Constitution of the Republic of Indonesia. Second, in the Surabaya District Court decision No. 916/Pdt.P/2022/PN/Sby, the perspective of Islamic family law rejects the application for marriage between individuals with different religious beliefs.
