PERLINDUNGAN HAK-HAK ANAK PASCA PERCERAIAN PERSPEKTIF HUKUM KELUARGA ISLAM (Studi Kasus Di Desa Saneo Kecamatan Woja Kabupaten Dompu Provinsi Nusa Tenggara Barat)

Abstract

The protection of children's rights has not been fully fulfilled, due to a lack of understanding by society or families regarding children's rights, it is felt that many children's rights that have been stated in law have not been fully fulfilled, if children's rights are not fulfilled, the problem of child neglect arises. This is in direct contrast to the protection of children's rights carried out in Saneo village. In this case, the problem formulation is raised as follows: 1. How are children's rights protected after divorce in Saneo village? 2. What is the analysis of Islamic family law on the practice of protecting children's rights after divorce in Saneot village? This research uses a qualitative approach, namely obtaining data sources from families related to the protection of children's rights in Saneo village. The research location is in Saneo village, data collection uses observation, interviews and documentation methods. The results of research on the protection of children's rights by ex- husbands and ex-wives, this is caused by the strained relationship between ex- husbands and ex-wives after divorce, low economic capacity, and inadequate understanding of children's rights from parents. Legal protection for children resulting from divorce from the perspective of Islamic law in Saneo village is that the father is still obliged to provide support for the child according to his ability, including a decent living, so that the child can live, grow and develop.
