Abstract

In marriage according to Islamic law, it is a marriage which means a very strong contract which, as explained in the Qur'an, namely Qs Ar-rum verse 21 and also explained in the Constitution no. 1 of 1974, as well as the prohibitions on marriage that already exist in Al-Qur'an and hadith, however, there are prohibitions on marriages that are not permitted but are not equal and there are no prohibitions on marriage in Islam in the customary prohibitions referred to here, namely the prohibition on marriages between members of the same tribe related to the pela gandong custom. Formulation of the problem 1) What is the form of the prohibition on marriage between the Seram tribe and the Kei tribe according to the pela gandong customary provisions, 2) What is the Islamic law analysis of the prohibition on marriage between the pela gandong when viewed from the sadd al-dhara'i' perspective. Meanwhile, the research location is Ilath village, Batabual subdistrict, Buru district. This type of qualitative research is used with a descriptive approach. Data collection through interviews, observation, documentation. The results of his research are that in Ilath village there has long been a ban on marriage between the Seram and Kei tribes, where these two tribes strictly prohibit marriage because it can cause disaster to befall the village, even if a marriage occurs, it is not only oneself who is affected by disaster, even the two Seram and Kei tribes all members of these two tribes will be affected by disaster.
