ANALISIS HUKUM TERHADAP DAMPAK NEGATIF PERJUDIAN PADA KEHARMONISAN KELUARGA (STUDI KASUS PERJUDIAN SABUNG AYAM DI DESA DENGKOL KECAMATAN SINGOSARI KABUPATEN MALANG)

Abstract

Gambling that is still carried out by the community, especially in the Malang Regency, Dengkol Village, Singosari District, is a type of cockfighting gambling activity. This activity is included in the criminal act of gambling which is regulated in Articles 303 and 303 bis of the Criminal Code. According to Duwi Handoko, there is no minimum criminal pattern for perpetrators of gambling crimes, whether regulated in the Criminal Code or outside the Criminal Code (controlled in the ITE Law). This requires special supervision which must be carried out by law enforcers aimed at eliminating this habit which violates the rules of both Islamic law and state law. Because fighting also harms the family, such as divorce and domestic violence. This research uses a qualitative descriptive approach, describing the negative impact of cockfighting gambling on family harmony. This type of research can be called empirical legal research or field research. The results of this research show that cockfighting has a negative impact in the form of divorce, domestic violence, and continuous disputes. Cockfighting is also considered to be contrary to Islamic law, namely Al-Quran surah Al-Maidah verse 90. As well as positive law, it violates the provisions of Article 303 of the Criminal Code. Also, it violates the provisions of Article 542 of the Criminal Code which is equivalent to the provisions of Article 303 bis of the Criminal Code.
