PERNIKAHAN BEDA AGAMA (ANALISIS YURIDIS PASCA TERBITNYA SEMA NOMOR 2 TAHUN 2023)

Abstract


This study addresses the deficiencies in regulations concerning interfaith marriages as outlined in Law No. 1 of 1974 on marriage, which have resulted in varied interpretations and insufficient legal certainty among stakeholders. Additionally, the enactment of Law No. 23 of 2006 on Population Administration has allowed for determining interfaith marriages through the judiciary, leading to inconsistencies in its application. In response, the Supreme Court issued Circular Letter Number 2 of 2023 to offer guidance to judges in adjudicating cases involving interfaith and belief-based marriage registrations. The research aims to assess the legal certainty and status of Circular Letter Number 2 of 2023 within the field of legal science. Utilizing a normative legal approach, including legislative and conceptual analyses, the study finds that the existence of Circular Letter Number 2 of 2023 enhances legal certainty concerning interfaith marriages. The Circular emphasizes adherence to Article 2, paragraph (1) of the Marriage Law in marriage registrations. While categorized as a legislative regulation, Circular Letter Number 2 of 2023 carries binding legal force following Article 8, paragraph (2) of the Legislation Formation Law, albeit its binding effect is limited to the judicial realm.
