Abstract


Islamic law and Indonesian positive law require special attention to the process of adopting a baby born in the womb. Even though there are differences between Indonesian positive law and Islamic law in the matter of adopting a child in the womb, the process of adopting a child in the womb can be understood by looking at and analyzing the applicable legal provisions of the two legal systems. And it is carried out properly in line with applicable law to ensure that the process of adopting a child in the womb can be carried out legally and formally according to Islamic law itself and Indonesian statutory law.
