PEMBAGIAN HARTA WARIS TERHADAP PASANGAN SUAMI ISTRI YANG TIDAK MEMILIKI KETURUNAN BERDASARKAN PERSPEKTIF HUKUM ISLAM

Abstract

Inheritance law is the law that controls the division of the inheritance of a deceased person. Inheritance law is very closely related to human life, because every human being will experience death. There are provisions stipulated in the Qur'an and Hadith and no one has the right to increase or decrease, therefore every Muslim must be aware of the obligation to comply with the inheritance law that has been determined by the Qur'an and Hadith. In a case that a few months ago became the talk of many people because there was a celebrity couple who revealed their decision not to have children (childfree). However, childfree is not a new concept in Indonesia. It is hoped that this research will be useful for the development of legal knowledge by providing input and connections to thoughts, especially for Islamic private law, more specifically inheritance law. This research is library research in nature. The results of the research suggest that the DPMUI Fatwa and Law Commission concluded that a married couple who decides not to have children is permissible in Islamic law, means something that does not conflict with Islamic teachings.
