Abstract


In Tanjung Sengkuang Village, Batam City, Riau Islands, there are wives who still demand the same amount of maintenance as the initial marriage agreement, even though the husband no longer has the same income. Based on the problem's description, the author will study Islamic law's standards for calculating the required minimum maintenance in line with the terms of the marriage contract and the demand for maintenance. The author of this paper employs qualitative research techniques. Interviews and observation are used to gather data. According to the study's findings, there are no explicit instructions in the Qur'an or hadith about the minimum level of maintenance that the husband must pay. Additionally, a wife has two options when her husband neglects to support her: she either wait it out or file for divorce. The wife must carry out her duties to her husband if she intends to exercise patience. However, if the wife chooses to file for divorce, she is not sinning. Therefore, Allah SWT has explained in Surah At-Thalaq verse 7, that a wife should not demand more than her husband earns or go beyond the prevailing tradition.
