Abstract


In this article, the author examines what are the problems of implementing wali taukil as the wali nasab is distant. the author uses the qualitative method. The results of the search obtained are the guardians in marriage, that is, the people who have the right to marry a woman, and the guardians are divided into 2, that The guardians are the guardian and the legal guardian. The nasab guardian is an angry bride's family member who is related by blood, and the marital guardian is a judge directly elected by the minister who has the right or authority to act as a marriage counselor for women without a guardian. This study refers to the PMA number 20 of 2019, one of the articles where there is an irregularity in the social situation, that is, it is necessary to define a guardianship commitment letter if the tutor has an excuse to practice nasab that he cannot meet. marriage contract of the girls under his guardianship. Transfer of custody in Islam is called taukil or wakalah, it is giving custody to another person to be done while the person is still alive.
