PERSPEKTIF IMAM MALIK DAN IMAM SYAFI’I TENTANG KAFA’AH NASAB TERHADAP PERNIKAHAN SYARIFAH DENGAN KALANGAN NON SAYYID
Abstract
In marriage there must be happiness, this can be obtained by the existence of a balance between men and women known as kafa'ah, many people want to have a son-in-law from among Arabs, therefore kafa'ah nasab is enforced in marriage. How did Imam Syafi’i and Imam Malik respond to the kafa'ah lineage in this marriage? The type of study used in this research is library research. The approach used in this research is a qualitative approach. This research is descriptive analysis, namely a method that describes and analyzes problems based on facts. Imam Syafi’i and his followers said that in marriage only holds the size of kafa’ah nasab, kafa’ah religion. kafa’ah work, independent status, and property or wealth. While Imam Malik said that there are only two kafa’ah in marriage, religion and the second is free from defects/disgrace, Imam Syafi’i said that in marriage only there is a measure of nasab kafa’ah, religious kafa’ah. kafa’ah job, independent status, and wealth. While Imam Malik said that there are only two kafa’ah in marriage, the first is religion and the second is free from disgrace, what is meant in this case is being free from leprosy, leprosy and others.
