BIROKRASI PERKAWINAN BEDA AGAMA DI INDONESIA (STUDI KASUS DI KBUPATEN MALANG)

Abstract

Interfaith marriage is a necessity to happen in Indonesia. This is due to the condition of the multi-religious Indonesian population. To this day, there are six recognized religions in Indonesia, not to mention the many local beliefs in Indonesia. So that interfaith marriages cannot be denied, especially for Muslims and Christians whose numbers tend to be major in Kepanjen District.

The research method uses empirical juridical research, with a qualitative approach. The results are translated into analytical descriptive form. The location of this research is in Kepanjen District, Malang Regency. The marriage model that occurs in Kepanjen District is through religious conversion, either temporarily or permanently. This is due to the fact that interfaith marriages are not regulated in the applicable law, the Dispendukcapil does not serve interfaith marriages and the public is reluctant to be complicated by court procedures. In this position, the Compilation of Islamic Law has actually clearly regulated, but this is still not effective at the community level
