ANALISIS PENYELESAIAN SENGKETA HARTA BERSAMA PASCA PERCERAIAN DI PENGADILAN AGAMA KOTA MALANG: PERSPEKTIF KOMPILASI HUKUM ISLAM

Abstract


This research is motivated by the increasing divorce rate in Malang City, which has the potential to trigger a rise in disputes over marital property following divorce. In practice, the Religious Court often faces various obstacles in resolving such disputes, particularly those related to evidentiary matters and the implementation of court decisions. Based on these circumstances, this study aims to examine the obstacles and solutions applied in the dispute resolution process, as well as to analyze the implementation of the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) in judicial practice. This study employs a qualitative method using an empirical legal research approach. The research data were obtained through observation, interviews, and documentation conducted at the Class IA Malang Religious Court. Primary data were collected from judges, court clerks, and officers of the One-Stop Integrated Service (Pelayanan Terpadu Satu Pintu/PTSP), while secondary data were derived from legislation, the Compilation of Islamic Law, court decisions, books, and scholarly journals. The data analysis process consisted of data collection, data reduction, data presentation, and conclusion drawing. In its implementation, several obstacles were identified, including the low level of legal awareness among the parties, difficulties in proving asset ownership, and the lack of complete evidence related to the disputed property. To overcome these challenges, the court seeks to optimize the mediation process, strengthen the evidentiary process through documentary evidence and witness testimony, and employ a persuasive approach toward the parties involved. The Compilation of Islamic Law serves as the primary legal basis in resolving marital property disputes, particularly Articles 85 to 97 of the KHI, while still taking into account the principles of justice and the factual circumstances of the parties during court proceedings.
