KONSEP KAFA’AH DALAM PERJODOHAN KYAI DI PESANTREN RAUDATUSSALIHIN (PERSPEKTIF MADZHAB IMAM SYAFI’I)
Abstract
This study examines the concept of kafā’ah in the matchmaking practices conducted by kyai at Raudatussolihin Islamic Boarding School from the perspective of the Shafi’i school of jurisprudence and family sociology, emphasizing the distinction between normative legal principles and their social implementation. The Shafi’i school asserts that kafā’ah is not a requirement for the validity of marriage but a right of the woman and her guardian, prioritizing religious commitment and moral character as the primary criteria, while lineage, social status, and economic factors serve as supporting considerations. This study employs qualitative field research methods and is analyzed using a descriptive-analytical approach. Data sources consist of primary data obtained through interviews with kyai, students, and guardians, as well as secondary data derived from Shafi’i jurisprudential literature and family sociology studies. The findings indicate that matchmaking practices at Raudatussolihin Islamic Boarding School are non-coercive and conducted through deliberation and consideration of students’ readiness. The differences between the normative framework of the Shafi’i school and pesantren practices are not contradictory but reflect divergent methodological orientations, in which Shafi’i jurisprudence emphasizes textual legal certainty, while pesantren practices prioritize social harmony and public welfare. Therefore, pesantren matchmaking practices can be understood as a form of living law that contextualizes Islamic law while remaining grounded in sharia principles.
