KONSEP DAN PRAKTIK BELIS DALAM PERNIKAHAN ADAT MASYARAKAT DESA NGGOREA KABUPATEN ENDE (PERSPEKTIF HUKUM ISLAM)

Abstract

The Belis tradition constitutes an essential element of customary marriage practices in Nggorea Village, Ende Regency. Belis is understood not merely as a customary obligation, but also as a symbol of social, cultural, and kinship values within the local community. This study aims to examine the concept of Belis, its implementation in customary marriage practices, and the perspective of Islamic law on the Belis tradition among the people of Nggorea Village. This research employs an empirical legal study with an anthropological legal approach. Data were collected through in-depth interviews with customary leaders, religious leaders, and community members directly involved in the practice of Belis. The data were analyzed using descriptive qualitative methods. The findings indicate that Belis is perceived as a customary tradition embodying values of respect, responsibility, deliberation, and cultural identity. The practice of Belis is carried out through structured customary stages and is determined based on family agreements. From the perspective of Islamic law, Belis is regarded as a permissible customary practice provided that it does not replace the obligatory mahr and does not impose undue burdens on the groom. This study shows that the practice of Belis continues to be maintained as a living tradition within the framework of Islamic legal principles applied by the community.
