STRATEGI PENANGGULANGAN NIKAH SIRI PADA KANTOR URUSAN AGAMA KECAMATAN TALIABU SELATAN KABUPATEN PULAU TALIABU PROVINSI MALUKU UTARA

Abstract

Islam views marriage as sacred because it meets the laws and standards of a valid marriage, which not only allows for the legitimate expression of sexual desire but also fulfills the sunnatullah that applies to all people. According to Law No. 1 of 1974, a marriage is considered valid if it is conducted in accordance with the rules of each religion and belief and documented in accordance with all relevant laws and regulations. As per the results of initial observations conducted by researchers at the South Taliabu District Religious Affairs Office, in fact, at the beginning of the establishment of the South Taliabu District KUA in 2019, in the area there were still many people who were carrying out unregistered marriages that had not been registered at the South Taliabu District Religious Affairs Office and this had been going on for decades. Based on the research context above, the focus of the research in the discussion of the thesis is: How is the practice of unregistered marriage in South Taliabu District, and what strategies are implemented by the KUA of South Taliabu District in dealing with unregistered marriage? The purpose of this study is to determine the practice of unregistered marriage in South Taliabu District and to determine what strategies are implemented by the South Taliabu District Office of Religious Affairs (KUA) in overcoming unregistered marriage. This study uses a qualitative approach and field methodology. The data collection methods used are observation, interviews, and documentation. The findings in the study related to the practice of unregistered marriage in the South Taliabu District KUA. There are several factors, namely, Economic Factors, Lack of Understanding Factors, Illegal Divorce Factors, Early Marriage Factors, and Delays in KUA Services in South Taliabu District. Efforts undertaken by the South Taliabu District Office of Religious Affairs (KUA) to address unregistered marriages include building cooperation with the Religious Court, conducting studies related to marriage, providing education and outreach on the importance of marriage registration and its negative impacts on families, children, and women, and building cooperation with government institutions in the South Taliabu District to support efforts in implementing the law.
