EFEKTIVITAS UU NO. 16 TAHUN 2019 DAN OPTIMALISASI PERAN PENGADILAN AGAMA TERHADAP PENURUNAN DISPENSASI NIKAH DI KOTA BLITAR

Abstract

Law Number 16 of 2019 concerning the Second Amendment to Law Number 1 of 1974 concerning Marriage has the main objective of reducing the number of early marriages in Indonesia. The main focus of this study is to identify the role of the Religious Court in efforts to prevent early marriage in Blitar City and assess the effectiveness of the implementation of Law Number 16 of 2019. Specifically, this study aims to determine the form of involvement of the Religious Court in preventing the practice of early marriage, while analyzing the effectiveness of Law Number 16 of 2019 in the jurisdiction of the Religious Court of Blitar City. The research methodology used is a qualitative descriptive approach. The research methodology used is a qualitative descriptive approach. Data collection techniques were carried out through observation, interviews, and documentation. The research location was determined at the Blitar Class 1A Religious Court, Blitar City, East Java Province. The results of field observations indicate that the Religious Court plays a very strategic role in efforts to prevent early marriage in Blitar City. This role is realized through enforcing applicable legal provisions, revoking marriage dispensations that do not meet the requirements, and providing education both inside and outside the court environment through outreach activities with the Women and Children Protection Service. Furthermore, the implementation of Law Number 16 of 2019 has proven effective in reducing the number of early marriages in Blitar City, with a significant decrease in the number of marriage dispensation applications from 2022 to 2024.
