EFEKTIFITAS PROSES MEDIASI DALAM KASUS PERCERAIAN DI PENGADILAN AGAMA BLITAR PERSPEKTIF ILMU KOMUNIKASI
Abstract
This study examines the effectiveness of mediation in divorce cases at the Religious Court of Blitar from the perspective of interpersonal communication. Mediation is a mandatory procedural stage aimed at encouraging peaceful settlement before the divorce trial proceeds. Although mediation has been formally implemented in accordance with Supreme Court Regulation No. 1 of 2016, the success rate of reconciliation remains relatively low. This study employs a qualitative descriptive approach, involving observations of mediation sessions, in-depth interviews with mediators and disputing spouses, and documentation analysis. The findings reveal that the mediation process is often hindered by emotional instability, defensive communication behavior, and a strong predetermined intention to divorce. These conditions limit the mediator's ability to facilitate balanced dialogue and mutual understanding. From the standpoint of interpersonal communication theory, particularly DeVito's concepts of openness, empathy, supportiveness, positivity, and equality, most mediation interactions lack the communicative characteristics necessary to establish constructive dialogue. The study concludes that the effectiveness of mediation depends not only on legal procedures but also on the emotional readiness of the parties and the mediator’s communication competence. Strengthening mediator training in emotional regulation and conflict communication, as well as providing psychological counseling support, is recommended to enhance future mediation outcomes.
