PENERAPAN HUKUM PERNIKAHAN PERSPEKTIF HUKUM ISLAM (Studi Kasus Pernikahan di Majelis Agama Islam Wilayah Pattani, Thailand Selatan)

Abstract

The application of marriage law from an Islamic legal perspective is an important part of the life of Muslim society, which regulates various aspects related to marriage, both in terms of conditions, pillars, rights, and obligations of husband and wife. This study aims to examine the application of marriage law from an Islamic legal perspective in the context of the Pattani Regional Islamic Religious Council, Southern Thailand. As a region with a majority Muslim population, Pattani has a marriage law system that refers to Islamic teachings, but also faces challenges in its application, given the influence of state law and local culture. In this study, the main focus is to understand the role and responsibilities of the Pattani Regional Islamic Religious Council in regulating marriage, including the implementation of marriage contracts, premarital guidance, and fulfillment of the rights of married couples. The research method used is qualitative with a case study approach, which involves interviews with the administrators of the Islamic Religious Council, religious leaders, and the local community. The study results show that the Pattani Regional Islamic Religious Council has a very significant role in regulating and supervising the implementation of marriage and guiding the rights and obligations of couples in forming a harmonious family. However, challenges such as differences in legal interpretation and the influence of local customs are factors that influence the optimal implementation of Islamic marriage law. This research is expected to contribute to strengthening the implementation of Islamic marriage law in Southern Thailand, especially in the Pattani region, and become a consideration in forming policies that are more responsive to the local social and cultural context.
