KESETARAAN PEREMPUAN DALAM PEMBAGIAN WARIS (STUDI HUKUM ISLAM DI INDONESIA)

Abstract


Before Islam came, there was inequality between men and women in the social order, the fate of women was very poor. In family life alone, wives were under the auspices of their husbands, it seemed that women did not have the rights they deserved. Then Islam gave a new light so that women could be fended off in their darkness, as in the Qur'an there is already a surah that explains about women as stated in the Kalam Allah in the surah An-nisa'. Is the Qur'anic ethos that elevates the status of women in relation to the idea of 2:1 descent between men and women still valid given current legal and social developments. So in this case the problem formulations raised are as follows: 1. How is Women's Equality in Inheritance Law in Indonesia? 2. How is the Analysis of Islamic Law on the Division of Women's Inheritance in Indonesia? This research uses the Normative Juridical method by using the approach of the Compilation of Islamic Law and the study approach to the opinions of scholars in fiqh books. In collecting legal materials, the author examines the literature relevant to the problem under study using primary legal materials and secondary legal materials. Furthermore, the legal material is analyzed by analyzing the materials obtained deductively, which is a way of thinking based on general rules and theories. Based on the results of research on Women's Equality in the Division of Inheritance (Study of Islamic Law in Indonesia), there is a comparison that women are treated unfairly or oppressed in terms of the division of inheritance. Although Islamic law has established the law of division between men and women, over time many women have experienced a shift in terms of carrying out the same responsibilities as men. This is the basis for the author to analyze the case.
