UPAYA MEDIATOR DALAM PENCEGAHAN PERCERAIAN (STUDI KASUS DI PENGADILAN AGAMA KABUPATEN MALANG)

Abstract

The number of Religious Courts in Malang Regency is increasing. By looking at the problems above, the author is interested in examining the extent of the efforts of the mediators at the Religious Court of Malang Regency. The focus of the research in compiling this thesis is how the mediator's strategy and process in mediating divorce cases at the Religious Court of Malang Regency, what are the inhibiting factors for the failure of mediators in reconciling disputing couples at the Religious Court of Malang Regency and how the mediator's efforts at the Religious Court of Malang Regency in reconciling disputing couples.

This study uses a qualitative approach, the type of research uses empirical research, data collection techniques are carried out using observation and interview methods. Research Findings related to the Process of implementing mediation in divorce cases at the Religious Court of Malang Regency, the mediation process at the Religious Court of Malang Regency is to register the case, towards the first trial. While the mediator's efforts in reconciling disputing couples are to create comfortable communication so that seeking a meeting point between the parties will easily encourage peace, advise, provide input, open awareness to parties who want to divorce, and provide solutions.
