PRINSIP BEST INTEREST OF THE CHILD PADA PUTUSAN PENGADILAN TINGGI AGAMA KENDARI No. 30/PDT.G/2024/PTA.KDI DALAM HUKUM ISLAM DAN HUKUM POSITIF

Abstract


This study examines the implementation of the principle of the best interest of the child in the decision of the Pengadilan Tinggi Agama Kendari Number 30/Pdt.G/2024/PTA.Kdi within the perspectives of Islamic law and Indonesian positive law. The research is motivated by the increasing number of divorce cases that raise disputes over child custody (ḥaḍānah), often creating tension between normative provisions and the substantive protection of children’s rights. This research is a normative juridical study employing statutory, conceptual, case, and comparative approaches. Primary legal materials include relevant legislation, the Kompilasi Hukum Islam, and the court decision, supported by secondary and tertiary legal sources. The findings indicate that, in Islamic law, the best interest principle is rooted in the concepts of ḥaḍānah and maqāṣid al-syarī‘ah, emphasizing child welfare and protection. In Indonesian positive law, this principle is institutionalized through child protection and marriage laws. The analyzed decision demonstrates a substantive application of the best interest principle by prioritizing the child’s psychological stability, continuity of care, and overall welfare over formal normative provisions. It concludes that the decision reflects a harmonious integration between Islamic law and positive law in safeguarding children’s rights.
