PERAN ADVOKAT DALAM PENYELESAIAN SENGKETA PERKAWINAN DI PENGADILAN AGAMA

Abstract

Based on Law no. 18 of 2003 concerning Advocate, people whose profession is to provide legal services inside and outside the court who have requirements based on the law. At the Religious Courts, advocates have several duties, one of which is assisting clients with problems in their marriage. These problems make someone have to use the services of an advocate to resolve their marital dispute. Because in this case the Advocate not only has the task of carrying out what he is authorized to do, but also must strive for peace between both parties. This research uses a qualitative approach, namely describing the role of advocates in resolving marriage disputes in religious courts. This type of research is called empirical legal research or field research. The results of this research show that the role of advocates in resolving marriage disputes in religious courts is quite good in providing legal services, starting from conducting mediation first, the aim of which is to reconcile the two parties first outside the court before the case goes to court, with the intention that husband and wife who want to divorce can abandon their intentions and make peace, but if after the mediation process is complete and the client still wants to continue the divorce process, then the Advocate will help assist in completing the divorce as best as possible per the Law and Code of Ethics Advocate.
