ANALISIS FATWA MAJELIS ULAMA INDONESIA (MUI) PROVINSI SULAWESI SELATAN NO.2 TAHUN 2022 TENTANG UANG PANAI’

Abstract

The Indonesian Ulema Council (MUI) of South Sulawesi on July 1, 2022 or 1 Dzulhijjah 1443 H issued fatwa No. 2 of 2022 concerning "Panai’ Money". The purpose of this study is to determine the background of the issuance, the method of legal istinbath and the analysis of MUI's fatwa on panai money'. The method used in this analysis uses a normative juridical approach with the types of primary data sources and secondary data sources. The results of this study show that the background of the issuance of fatwas on panai’ money is due to a shift in the cultural meaning of panai money, which was originally a form of appreciation to women's families, now becomes a place for show off and prestige and public lies. The legal istinbath method used in the South Sulawesi MUI fatwa on panai’ money is from the verses of the Qur'an, Hadith, the rules of ushul fiqh, the opinions of the fuqaha, as well as the Constitution (UUD) and the Compilation of Islamic Law related to this fatwa. In addition, the law of giving panai money is permissible (mubah) as long as it does not violate sharia principles in panai’ money. As for the positive impact of panai' money, one of them is as a form of appreciation for the woman's family and glorifying her. While the negative impact of panai money is the occurrence of various forms of crime such as stealing, gambling, usury and others to meet panai’ money.
