PERSPEKTIF HUKUM ISLAM TERHADAP BUDAYA PERNIKAHAN SALEP TARJHE (Studi Kasus: Dusun Tongoh Barat,Pangongsean,Torjun,Sampang,Madura)

Abstract

Tarjhe salep wedding is a type of marriage that is prohibited in the Madurese tribe, because it is believed that it will bring disaster and disaster for the perpetrator, such as sake, an (illness), his fortune will be difficult even until the perpetrator dies.  This tarjhe ointment marriage in language is ointment which means each other or precedes while tarjhe is kicking.  The culture of prohibiting tarjhe ointment marriage is still strong among the people of West Tongoh Hamlet, Pangongsean, so a deeper understanding of marriage law is needed in accordance with Islamic law. From the research context above, the intent and purpose of this study is to answer the research focus on the saleptarjhe marriage.  How is the tarjhe ointment wedding culture practiced and developed in Tongoh Barat Hamlet, Pangongsean, Torjun, Sampang.  The method used in this research is using a qualitative approach to the type of case study research. Data collection techniques through observation, interviews, and documentation.  The subjects in this study were religious leaders, traditional leaders, government leaders and the community. The results of this study are that the social impact that will be obtained for people who violate these customs is very large as they become material for the talk of the community and become a reference when bad things happen to their lives.  This tarjhe salep marriage is justified according to Islamic law but is prohibited according to customary provisions of the people of West Tongoh Hamlet, Pangongsean, Torjun, Sampang because it is believed that it will bring disaster or disaster to the perpetrator or one of his family.
