ANALISIS YURIDIS TERHADAP PERUBAHAN BIODATA AKTA NIKAH KARENA PINDAH AGAMA (Studi Penetapan Pengadilan Agama Jember Nomor 2069/Pdt.P/2021/PA.Jr)

Abstract


The Jember Religious Court received a request to change the marriage certificate biodata due to moving  religion. The purpose of this study is to describe the legal considerations of judges,  and describe the juridical analysis of the determination of the Jember Religious Court Number  2069/Pdt.P/2021/PA.Jr. This type of research is library research, namely:  research that takes primary data in the form of a copy of the Determination of the Jember Religious Court  Case Number: 2069/Pdt.P/2021/PA.Jr, with a juridical approach and a case approach. It can be concluded that the ratio decidendi or legal considerations the judge in the determination of number 2069/Pdt.P/2021/PA.Jr is based on a Ministerial Regulation  Religion Number 11 of 2007 concerning marriage registration Article 34 paragraph (2) which states:  that changes concerning the biodata of the husband, wife, or guardian must be based on  decision of the Court in the area concerned. With the issuance of the determination  Number 2069/Pdt.P/PA.Jr concerning amendments to the marriage certificate, can become jurisprudence for the  other judges in deciding cases when they encounter the same problem.
