ANALISIS PERKARA PEMBATALAN AKIBAT PEMALSUAN IDENTITAS CALON PENGANTIN DALAMLPERKAWINAN (StudiLPutusan LPengadilan Agama Gresik Nomor 1236/Pdt.G/PA.Gs)

Abstract

Based on the decision of the Gresik Religious Court number 1236/Pdt.G/2019/PA.Gs, there has been a marriage using a false identity. The focus of the research in the discussion of the thesis that was submitted for the case of marriage annulment related to falsifying identity at the Gresik Religious Court, due to the annulment of marriage with identity falsification. This study uses a qualitative approach and normative juridical research. The data collection instruments used were observation, interviews, and documentation. The results of this study indicate, firstly, the judge's consideration in the decision is in accordance with the mature through deliberation of the panel of judges. When one of the parties commits identity falsification, the marriage should not be valid because the identity of one of the parties is not clear. Second, the result of the cancellation of marriage due to identity falsification has legal consequences for marital status, child status, and also on the status of joint property.
