URGENSI PENERAPAN RESTORATIVE JUSTICE DALAM PENYELESAIAN PELANGGARAN DISIPLIN MILITER (STUDY KASUS PUTUSAN DILMIL.III-12 SURABAYA NO.68-K/ PM.III-12/AL/III/2017)
Abstract
ABSTRACK
This thesis stems from a critical reflection on the punitive and legal-formal approach that dominates Indonesia’s military justice system. In many cases, military personnel who commit minor offenses—such as being absent without leave (AWOL or THTI)—are subjected to full criminal prosecution, without consideration for psychological factors, personal motivations, or the potential for rehabilitation. A concrete example analyzed in this research is the decision of the Military Court III-12 Surabaya, Case Number 68-K/PM.III-12/AL/III/2017.
In this case, a Navy soldier holding the rank of Second Sergeant was sentenced to 3 months in prison for being absent from duty for 35 days without permission. Although the defendant voluntarily surrendered, admitted his mistake, and caused no material or institutional harm, the legal process proceeded strictly through formal judicial channels, with no option for non-repressive or restorative settlement. This reveals a legal vacuum in the application of restorative justice (RJ) within the military justice system, even though the case fulfilled key elements for RJ—such as acknowledgment of guilt, lack of direct victim, and the soldier’s willingness to reintegrate into military service.
Using normative legal research methods, this study employed statutory, conceptual, and case study approaches. Through analysis of existing regulations—including Law No. 31 of 1997 on Military Courts and the Military Penal Code (KUHPM)—it was found that there is no explicit legal basis allowing for restorative justice in military law. However, the recent issuance of judicial instruments such as Supreme Court Regulation (PERMA) No. 1 of 2024 and Supreme Court Circular Letter (SEMA) No. 2 of 2024 indicates a growing openness to resolving certain military cases, such as minor desertion or THTI, through restorative mechanisms.
The thesis concludes that Indonesia’s military legal system remains highly repressive and lacks the flexibility to accommodate a more humane, participatory, and rehabilitative approach. Yet, restorative justice presents a viable alternative that upholds military discipline while also protecting the rights of soldiers as equal citizens under the law. Therefore, concrete steps must be taken to integrate RJ principles into military justice—through regulatory reform, the development of operational guidelines, and capacity building for military legal personnel to implement RJ in a responsible and context-sensitive manner.

Penelitian ini berangkat dari keprihatinan terhadap pendekatan hukum yang dominan digunakan dalam sistem peradilan militer Indonesia, yang cenderung represif dan legal-formal. Dalam banyak kasus, prajurit yang melakukan pelanggaran ringan, seperti ketidakhadiran tanpa izin (THTI), diproses secara penuh melalui mekanisme pidana militer, tanpa mempertimbangkan kondisi psikis, motif personal, maupun potensi untuk rehabilitasi dan pembinaan. Salah satu contoh konkret yang dianalisis dalam skripsi ini adalah Putusan Pengadilan Militer III-12 Surabaya Nomor 68-K/PM.III-12/AL/III/2017.
Dalam kasus tersebut, seorang prajurit TNI AL berpangkat Sersan Dua dijatuhi pidana penjara selama 3 bulan karena meninggalkan dinas selama 35 hari tanpa izin. Meskipun terdakwa secara sukarela menyerahkan diri, mengakui kesalahan, dan tidak menimbulkan kerugian terhadap negara maupun institusi, proses hukum tetap dijalankan secara formal tanpa opsi penyelesaian non-represif. Hal ini menunjukkan kekosongan ruang keadilan restoratif dalam sistem peradilan militer, padahal secara substansi, perkara tersebut memenuhi unsur-unsur yang ideal untuk diselesaikan melalui pendekatan pemulihan, seperti adanya penyesalan, tidak adanya korban langsung, dan kemauan untuk kembali berdinas.
Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus. Melalui analisis terhadap peraturan yang berlaku, termasuk UU No. 31 Tahun 1997 tentang Peradilan Militer dan KUHPM, ditemukan bahwa belum terdapat dasar hukum eksplisit yang membuka ruang bagi pendekatan restorative justice. Namun demikian, kemunculan instrumen yudisial baru seperti PERMA No. 1 Tahun 2024 dan SEMA No. 2 Tahun 2024 menunjukkan bahwa Mahkamah Agung mulai membuka peluang bagi penyelesaian perkara pidana secara restoratif, termasuk di lingkungan militer dalam perkara tertentu seperti desersi ringan dan THTI.
Kesimpulan dari penelitian ini menegaskan bahwa sistem hukum militer Indonesia masih sangat menekankan pendekatan penghukuman dan belum membuka ruang bagi model penyelesaian yang lebih edukatif, partisipatif, dan membina. Padahal, restorative justice dapat menjadi solusi alternatif untuk mempertahankan nilai-nilai disiplin militer sekaligus melindungi hak-hak prajurit sebagai warga negara yang setara di hadapan hukum. Oleh karena itu, dibutuhkan langkah konkret untuk mengintegrasikan prinsip keadilan restoratif ke dalam sistem hukum militer, baik melalui revisi peraturan, penyusunan SOP, maupun pelatihan bagi para penegak hukum militer agar mampu mengimplementasikan pendekatan ini secara efektif dan bertanggung jawab.
