TINJAUAN HUKUM TERHADAP KEWAJIBAN MENJADI PENERIMA PROTOKOL NOTARIS

Abstract

ABSTRACT

The Notary Protocol is a state archive that must always be guarded and maintained by the Notary, this is the mandate of Article 1 Number 13 of Law Number 30 of 2004 concerning the Notary Position (UUJN). This includes the protocol of a Notary who will be released or relinquish his position as a Notary as referred to in Article 62 of the UUJN. Therefore, the notary protocol must be transferred to another notary called the protocol recipient notary as stipulated in Article 63 of the UUJN. The delegation of the protocol is an obligation that must be accepted by the protocol recipient notary because based on Article 64 of the Regulation of the Minister of Law and Human Rights Number 19 of 2019 concerning Conditions and Procedures for Appointment, Leave, Transfer, Dismissal, and Extension of the Term of Office of Notaries requires that the notary appointed as the protocol recipient must comply with the appointment.

ABSTRAK

Protokol Notaris merupakan arsip negara yang harus selalu di jaga dan dipelihara oleh Notaris, hal tersebut merupakan amanat dari Pasal 1 Angka 13 Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris (UUJN). Termasuk pada Protokol dari seorang Notaris yang akan lepas atau melepaskan jabatannya sebagai Notaris sebagaimana yang dimaksud pada Pasal 62 UUJN. Oleh sebab itu, protokol notaris tersebut wajib untuk dialihkan kepada notaris lain yang disebut sebagai notaris penerima protokol sebagaimana yang diatur pada Pasal 63 UUJN. Pelimpahan terhadap protokol tersebut merupakan kewajiban yang harus diterima oleh notaris penerima protokol karena berdasarkan Pasal 64 Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 19 Tahun 2019 tentang Syarat dan Tata Cara Pengangkatan, Cuti, Perpindahan, Pemberhentian, dan Perpanjangan Masa Jabatan Notaris mewajibkan notaris yang ditunjuk sebagai penerima protokol harus patuh terhadap penunjukan tersebut.
