PERLINDUNGAN HUKUM TERHADAP PELANGGARAN HAK CIPTA PENULISAN DI APLIKASI DIGITAL (WATTPAD) BERDASARKAN UNDANG-UNDANG NOMOR 28 TAHUN 2014 TENTANG HAK CIPTA

Abstract

            In this thesis, the author raises the issue of legal protection against copyright infringement of writing in digital applications (wattpad) based on law number 28 of 2014 concerning copyright. With the background of many ordinary people who commit violations or plagiarism against other people's copyright works in the wattpad digital application.

Based on this background, the formulation of the problem is as follows: 1. What is the form of copyright infringement of the written content in the wattpad digital application? 2. How is the legal protection of content owners in the wattpad digital application 3. How are the efforts to resolve disputes if there is a copyright violation in the wattpad application, which is examined juridically normatively

The results of the research, namely, the form of violations that often occur in the wattpad application is plagiarizing the work of others, preventive efforts to reduce copyright violations in the form of Law Number 28 of 2014 concerning Copyright, repressive protection, final protection in the form of sanctions such as imprisonment. conducted through dispute settlement outside the court

ABSTRAK

 

Pada skripsi ini, penulis mengangkat permasalahan perlindungan hukum terhadap pelanggaran hak cipta penulisan di aplikasi digital (wattpad) berdasarkan undang-undang nomor 28 tahun 2014 tentang hak cipta. dilatarbelakangi banyak orang awam yang melakukan pelanggaran atau plagiasi terhadap karya cipta orang lain di aplikasi digital wattpad.

Berdasarkan latar belakang tersebut, rumusan masalah sebagai berikut : 1.Bagaimana bentuk pelanggaran hak cipta terhadap konten penulisan di aplikasi digital wattpad? 2.Bagaimana perlindungan hukum pemilik konten di aplikasi digital wattpad 3.Bagaimana upaya penyelesaian sengketa apabila terjadi pelanggaran hak cipta penulisan di aplikasi wattpad,diteliti secara yuridis normatif.

Hasil penelitian yaitu, bentuk pelanggaran yang sering terjadi di aplikasi wattpad adalah memplagiat hasil karya orang lain, upaya preventif mengurangi tindakan pelanggaran Hak Cipta berupa Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, perlindungan represif perlindungan akhir berupa sanksi seperti penjara Upaya penyelesaian sengketa dapat dilakukan melalui penyelesaian sengketa di luar pengadilan.
