PERLINDUNGAN HUKUM BAGI TENAGA KERJA PEREMPUAN BERDASARKAN UNDANG – UNDANG NOMOR 13 TAHUN 2003 TENTANG KETENAGAKERJAAN (Studi di RS. Dian Husada Mojokerto)

ABSTRACT

 

Women workers are arguably special workers, why is that, because they have many special things, such as menstruation, childbirth, breastfeeding and uterine pregnancy. The formulation of the problem of this research is the legal protection for women workers and how to standardize legal protection for women workers based on Law No. 13 of 2003 concerning Labor. The research method used in this study is juridical empirical, by conducting interviews with the head of the human resources sub division and labor in the hospital. The conclusion from this study the hospital still has not carried out some of its duties to provide protection for example such as providing transportation for shuttle to workers who shift the night, then the solution is to seek for the shuttle.

ABSTRAK

 

Tenaga kerja perempuan bisa dibilang tenaga kerja istimewa, kenapa demikian, karena mereka mempunyai banyak hal yang istimewa, seperti haid, melahirkan, menyusui dan gugur kandungan. Rumusan masalah dari penelitian ini adalah perlindungan hukum bagi tenaga kerja perempuan dan bagaimana standarisasi perlindungan hukum bagi tenaga kerja perempuan berdasarkan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Metode penelitian yang digunakan dalam penelitian ini adalah empiris yuridis, dengan melakukan wawancara dengan kepala sub bagian sdm dan tenaga kerja dirumah sakit. Kesimpulan dari penelitian ini pihak rumah sakit masih belum melaksanakan beberapa tugasnya untuk memberikan perlindungan contohnya seperti memberikan transportasi untuk antar jemput bagi tenaga kerja yang shift malam, maka solusinya yaitu mengupayakan untuk adanya antar jemput.
