PERLINDUNGAN HUKUM TERHADAP INVESTOR ATAS DIBERLAKUKANNYA FORCED DELISTING DI BURSA EFEK INDONESIA DAN AKIBAT HUKUMNYA

Abstract

Writers discussed related to the protection of laws against investors over the enactment of the forced delisting at the Indonesian Stock Exchange and effect the law. The choice of the topic on the following conditions some event forced delisting bond issuers at the Indonesian Stock Exchange. The formulation of matter as follows: 1. What was the protection of the law rendered against forced delisting by issuers investors due to the Indonesia Stock Exchange? 2. Is there investment belonging to investors due to the repayment of loans issuers forced delisting by the Indonesian Stock Exchange? Research was used in the study of juridical law approach normative by means of legislation and the case. Data collection through study literature available and study of documents. Furthermore, the data analyzed, to be cultivated and discussed the data to answer the formulation of the problem. Stated that the result of this research the absence of the form of the protection of the law rendered against investors of the nature of the forced delisting. There is no repayment of funds investment by investors and issuers either by the stock exchange. The repayment of the funds was undertaken with do his bidding in the market negotiation. There should have been a policy governing related to the protection of laws against investors of the nature of the forced delisting on the exchange and repayment of of the invested funds by investors.

Penulis membahas mengenai Perlindungan Hukum Terhadap Investor Atas Diberlakukannya Forced Delisting Di Bursa Efek Indonesia Dan Akibat Hukumnya. Pilihan topik tersebut dilatarbelakangi oleh beberapa peristiwa forced delisting emiten di Bursa Efek Indonesia. Rumusan masalah sebagai berikut: 1. Bagaimana bentuk perlindungan hukum yang diberikan terhadap investor akibat forced delisting emiten oleh Bursa Efek Indonesia? 2. Apakah ada pengembalian dana investasi milik investor akibat forced delisting emiten oleh Bursa Efek Indonesia? Penelitian ini menggunakan penelitian hukum yuridis normatif dengan mengunakan pendekatan Perundang-undangan dan kasus. Pengumpulan data melalui studi kepustakaan dan studi dokumen. Selanjutnya data dianalisis, diolah dan dibahas mengenai data tersebut untuk menjawab rumusan masalah yang ada. Hasil penelitian ini menyatakan bahwa, belum adanya bentuk perlindungan hukum yang diberikan terhadap investor atas terjadinya forced delisting. Tidak ada pengembalian dana investasi yang dilakukan oleh investor baik oleh emiten maupun bursa efek. Pengembalian dana dilakukan dengan melakukan penawaran di pasar negosiasi. Perlu adanya kebijakan yang mengatur mengenai perlindungan hukum terhadap investor atas terjadinya forced delisting di bursa dan pengembalian dana yang di investasikan oleh investor.
