Mahkamah Konstitusi dalam Putusan Mahkamah Konstitusi Nomor 93/PUU-X/2012, terkait penyeleseian perbankan syariah yang menimbulkan ketidakpastian hukum atau terjadi dualisme kewenangan memutuskan perkara antara Pengadilan Negri dan Pengadilan Agama. Didasarkan atas  hasil penelitian yang telah dilakukan, bahwa Mahkamah Konstitusi mengabulkan permohonan pengujian Undang-Undang Nomor 21 Tahun 2008 Tentang Perbankan Syariah  menyatakan bahwa keseluruhan penjelasan pasal 55 ayat 2 Undang-Undang Nomor 21 Tahun 2008 Tentang Perbankan Syariah  tidak mempunyai kepastian hukum, dalam pasal tersebut terdapat dualisme penyeleseian sengketa sehingga bertentangan dengan pasal 28D ayat  Undang Undang Dasar 1945, yang kedua apa alasan putusan atau ratio decidendi  hakim Mahkamah Konstitusi dalam memutuskan perkara uji materi putusan Mahkamah Konstitusi Nomor 93/PUU-X/2012.

The Constitutional Court in the Decision of the Constitutional Court Number 93 / PUU-X / 2012, related to the completion of Islamic banking which caused legal uncertainty or dualism occurred in the authority to decide cases between the State Court and the Religious Court. Based on the results of the research that has been conducted, that the Constitutional Court granted the request for testing Law Number 21 of 2008 concerning Sharia Banking stating that the whole explanation of article 55 paragraph 2 of Act Number 21 of 2008 concerning Sharia Banking has no legal certainty, in the article there is a dualism of dispute resolution so that it contradicts article 28D paragraph of the 1945 Constitution, the second is the reason for the decision or ratio of decidendi of the Constitutional Court judge in deciding the material test case of the Constitutional Court decision No. 93 / PUU-X / 2012.
