PERAN DINAS SOSIAL DALAM PENDAMPINGAN ADOPSI ANAK SECARA SAH (STUDY KASUS ADOPSI ANAK DI DINAS SOSIAL KOTA BATU)
Abstract
ABSTRACT
Child adoption is a legal effort to protect children who do not receive proper care from their biological families. In Indonesia, the adoption process must follow legal procedures to ensure the fulfillment of children's rights and legal certainty. However, in practice, many adoptions are carried out informally without supervision or approval from authorized institutions, raising potential risks of legal violations and child rights abuse. This study aims to examine the role of the Social Affairs Office of Batu City in the legal adoption process and to analyze the legal consequences of adoption practices that do not comply with Indonesian law.
This research uses a qualitative method with an empirical legal research approach. Data were collected through literature review and interviews with relevant stakeholders in the Batu City Social Affairs Office. The analysis is conducted using a descriptive-analytical method and employs role theory as the analytical tool.
The findings show that the Social Affairs Office of Batu City plays a significant role throughout the legal adoption process, including community outreach, eligibility assessments of prospective adoptive parents, administrative verification, issuing recommendations to the court, and post-adoption monitoring. This comprehensive support ensures the adoption process prioritizes the best interest of the child. On the other hand, adoptions conducted outside legal procedures may result in legal sanctions such as annulment of adoption status and are considered violations of the Child Protection Law.
This study recommends strengthening the educational and advocative roles of the Social Affairs Office, improving the capacity of social workers, and expanding public awareness of legal adoption procedures to prevent illegal adoptions.

ABSTRAK
Adopsi anak merupakan salah satu bentuk perlindungan hukum terhadap anak yang tidak memperoleh pengasuhan layak dari keluarga asalnya. Praktik adopsi di Indonesia harus memenuhi persyaratan hukum agar memberikan kepastian dan perlindungan terhadap hak-hak anak. Namun, dalam realitas sosial, masih banyak proses adopsi dilakukan secara informal tanpa melibatkan instansi berwenang, yang berpotensi menimbulkan pelanggaran hak anak. Penelitian ini bertujuan untuk mengkaji peran Dinas Sosial Kota Batu dalam pendampingan proses adopsi anak secara sah serta menganalisis sanksi hukum terhadap adopsi yang tidak sesuai dengan ketentuan hukum positif di Indonesia.
Penelitian ini menggunakan metode pendekatan kualitatif dengan jenis penelitian hukum empiris. Data diperoleh melalui studi pustaka dan wawancara dengan pihak-pihak terkait di Dinas Sosial Kota Batu. Analisis dilakukan dengan pendekatan deskriptif-analitis dan teori peran sebagai pisau analisis.
Hasil penelitian menunjukkan bahwa Dinas Sosial Kota Batu memiliki peran penting dalam setiap tahapan proses adopsi, mulai dari penyuluhan, asesmen terhadap calon orang tua angkat, verifikasi administrasi, pemberian rekomendasi kepada pengadilan, hingga pemantauan pasca-adopsi. Pendampingan ini bertujuan memastikan bahwa proses adopsi dilakukan demi kepentingan terbaik anak. Di sisi lain, adopsi yang dilakukan tanpa melalui jalur hukum formal dapat dikenai sanksi hukum berupa pembatalan status adopsi, serta dianggap sebagai pelanggaran terhadap Undang-Undang Perlindungan Anak.
Penelitian ini merekomendasikan perlunya penguatan peran edukatif dan advokatif Dinas Sosial, peningkatan kapasitas pekerja sosial, serta sosialisasi regulasi adopsi kepada masyarakat luas guna mencegah praktik adopsi ilegal.
