KEBIJAKAN KRIMINAL PENGHINAAN TERHADAP PRESIDEN DAN WAKIL PRESIDEN MENURUT UNDANG-UNDANG NOMOR 1 TAHUN 1946 DAN UNDANG-UNDANG NOMOR 1 TAHUN 2023 TENTANG KUHP

Abstract

ABSTRACT

            The President is the head of state and head of Government of the Republic of Indonesia. As head of state, the president is the official symbol of the republic of Indonesia in the world. So that as head of state or state symbol, the President and Vice President must protect their honor and dignity from things that are insulting or that demean the indentity of the head of state. There are 2 (two) problem formulations in this research, namely: 1) What are the acts that are criminalized for insulting the President and Vice President in law No. 1 of 2023 concerning the criminal code? 2) What are the differences between the articles regarding insulting the President and Vice President Jo. UU No. 1 of 1946 concerning the criminal code with articles on insultingthe president and Vice President according to law No. 1 of 2023 concerning the criminal code?. The research method used in normative legal research with a statutory and historical approach. The results of this research review criminal acts in the category of insulting the President and Vice President in Law Number 1 of 2023 Concerning the Criminal Code. The author really hopes that the general public will not insult the President and Vice President as symbols of the state, but as head of government it is very permissible to criticize their arbitrary policies.

ABSTRAK

            Presiden adalah kepala Negara sekaligus Kepala Pemerintahan Republik Indonesia. Sebagai kepala Negara, presiden adalah simbol resmi Negara Republik Indonesia di dunia. Sehingga sebagai Kepala Negara atau Simbol Negara, Presiden dan Wakil Presiden harus di jaga harkat dan martabatnya dari hal-hal Penghinaan atau yang merendahkan jati diri Kepala Negara. Terdapat 2 (dua) rumusan masalah dalam penelitian ini, yakni: 1) Apa saja perbuatan-perbuatan yang dikriminalisasi penghinaan Presiden dan  Wakil Presiden dalam Undang-undang No. 1 Tahun 2023 tentang KUHP ? 2) Apa perbedaan pasal-pasal penghinaan terhadap presiden dan wakil presiden Jo.UU No. 1 Tahun 1946 Tentang KUHP dengan Pasal-pasal Penghinaan terhadap  Presiden dan wakil presiden menurut UU No.1 Tahun 2023 Tentang KUHP ?. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan historis. Hasil penelitian ini meninjau tentang Tindak Pidana Dalam Kategori Penghinaan Terhadap Presiden dan Wakil Presiden dalam Undang-Undang Nomor 1 tahun 2023 Tentang KUHP. Penulis sangat mengharapkan kepada seluruh masyarakat luas untuk tidak menghina Presiden dan wakil Presiden sebagai simbol negara, tetapi sebagai kepala pemerintahan sangat boleh untuk mengkritisi kebijakannya yang sewenang-wenang.
