CONCRETE REVIEW: PERBANDINGAN AUSTRIA, JERMAN DAN KROASIA SERTA FORMULASI IDEAL PENGATURANNYA DI INDONESIA

Abstract


This study reviews concrete review arrangements in Austria, Germany and Croatia as well as their institutionalization mechanisms in Indonesia. The method used is normative juridical, with statutory, conceptual, historical and comparative approaches. The collection of legal materials is carried out through the study of documentation and literature, then analyzed qualitatively. The results showed that the mechanism of concrete review of constitutional review in Austria, Germany and Croatia is basically the same, that is, submitted by judges from ordinary courts (courts other than the Constitutional Court) to the Constitutional Court, while the judges concerned in adjudicating cases doubt the constitutionality of a law to be applied in such cases. The only difference lies in the legal standing of ordinary court judges who can apply for concrete review. In Austria and Germany, all judges of ordinary courts of first instance to the highest court have legal standing to submit concrete reviews to the Constitutional Court when doubting the constitutionality of the law to be applied in the concrete case at hand. In Croatia, only judges of the highest court have legal standing to apply for concrete review. In order to institutionalize it in Indonesia, concrete review arrangements need to be regulated in the 1945 NRI Constitution, to strengthen the constitutional legitimacy of concrete review in the legal review system in Indonesia.
