REFERENDUM WILAYAH DONETSK-REPUBLIK UKRAINA DENGAN REPUBLIK FEDERASI RUSIA DALAM PERSPEKTIF HUKUM INTERNASIONAL

Abstract


ABSTRACTCurrently, there are problems related to referendums in the Donetsk-Republic of Ukraine region and the Russian Federation Republic. Based on this background, the authors formulate 3 (three) problem formulations, namely: Why does the Donetsk region-Republic of Ukraine wish to join the Russian Federation Republic, What are the arrangements regarding Referendums for merging regions Donetsk-Republic of Ukraine with the Russian Federation according to International Law, What are the legal consequences of the Referendum merging the Donetsk-Republic of Ukraine with the Russian Federation without involving the United Nations, In terms of answering the formulation of the problem the author uses normative juridical research methods, and gets the result that the reason for the Donetsk region -The Republic of Ukraine wants to join the Russian Federation Republic is because the citizens of Donetsk-Republic of Ukraine want full autonomy, and also want to join the Russian Federation Republic, secondly that the referendum that took place in Donetsk-Republic of Ukraine is legal, , but cannot be considered fully legal, thirdly, for the referendum that took place, the Russian Federation must bear all sanctions from the United Nations, as stated in the United Nations General Assembly A/ES-11/L.5.Keywords: Referendum, Right to Self-Determination, Regulation, International Law.ABSTRAKDewasa ini terjadi permasalahan terkait referendum di wilayah Donetsk-Republik Ukraina dengan Republik Federasi Rusia berdasarkan latar belakang inilah penulis merumuskan 3 (tiga) rumusan masalah, yakni: Mengapa wilayah Donetsk-Republik Ukraina berkeinginan bergabung dengan Republik Federasi Rusia, Bagaimana pengaturan terkait Referendum penggabungan wilayah Donetsk-Republik Ukraina dengan Republik Federasi Rusia menurut Hukum Internasional, Bagaimana akibat hukum Referendum penggabungan wilayah Donetsk-Republik Ukraina dengan Republik Federasi Rusia tanpa melibatkan PBB, Dalam hal menjawab rumusan masalah tersebut penulis menggunakan metode penelitian yuridis normatif, dan mendapatkan hasil bahwa alasan wilayah Donetsk-Republik Ukraina ingin bergabung dengan Republik Federasi Rusia adalah karena warga Donetsk-Republik Ukraina menginginkan otonomi penuh, dan juga ingin bergabung dengan Republik Federasi Rusia, kedua bahwa referendum yang terjadi di Donetsk-Republik Ukraina adalah sah, , namun tidak bisa dianggap sepenuhnya sah, ketiga atas referendum yang terjadi, Republik Federasi Rusia harus menanggung segala sanksi dari PBB, yang tertuang dalam United Nations General Assembly A/ES-11/L.
