EFEKTIVITAS BATAS MAKSIMUM PENGUASAAN TANAH BERDASARKAN PERATURAN MENTERI AGRARIA NO 18 TAHUN 2016

Undang-Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA), dalam Pasal 17 ayat (1) menyatakan tentang batas maksimum dan minimum tanah pertanian yang boleh dimiliki dan dikuasai oleh satu keluarga, tujuan pasal ini yaitu agar tidak merugikan kepentingan umum dan keadilan bagi pemilik tanah. Peraturan pelaksanaan UUPA di keluarkan Undang-Undang No. 56 Prp Tahun 1960 tentang Penetapan Luas Tanah Pertanian dan pada tahun 2016 di keluarkan peraturan menteri Agratia No 18 Tahun 2016 Tentang Pengendalian Penguasaan Tanah Pertanian sebagai penegasan Undang-Undang sebelumnya. Dengan adanya program pemerintah PTSL (Pendaftaran Tanah Sistemaris Lengkap) Maka pengendalian penguasaan tanah yang melebihi batas dapat terkontrol oleh kantor pertanahan. Karena penguasaan tanah yang melampaui batas tidak diperkenankan karena tidak mencerminkan pancasila sila ke 5 yang berbunyi keadilan sosial bagi seluruh rakyat Indonesia.
